Bakebe Sessions Terms & Conditions
This agreement outlines the important considerations for reserving, experiencing, and paying for Bakebe MY sessions. Please read thoroughly and understand all the items outlined below prior to signing of contract. Wherein this document, “Bakebe” refers to retail locations in MY at Lot 5, 6 & 7, Level G3, Block C2, Publika Shopping Centre, No. 1, Jalan Dutamas 1, Solaris Dutamas, 50480, Kuala Lumpur. “Customer” refers to party who pays for experience in Bakebe. [1] “Session” refers to the time spent during the designated booking time on Bakebe premise. “Franchisee” refers to local partners of Bakebe in respective countries but are not wholly owned nor subsidiaries of Bakebe unless otherwise specified. [2] “[3] Studio” references the retail space wherein Customers participate in their Sessions. [4] “Terms” refers to this Terms and Condition document outlined below. “You” refers to the Customer or Customers about to participate in Session, who must sign and acknowledge these Terms in order to begin Session.
Terms of Use
1.1 Acceptance of Terms. By accessing Bakebe Studio, you accept and agree to be bound by these Terms, just as if you had agreed to these Terms in writing.
1.2 Amendment of Terms. Bakebe may amend the Terms from time to time. Unless we provide a delayed effective date, all amendments will be effective upon posting of such updated Terms. Your continued access to Studios or sessions after such posting constitutes your consent to be bound by the Terms, as amended.
1.3 Additional Terms. In addition to these Terms, certain plans, offers, products, services, elements or features may also be subject to additional terms, conditions guidelines or rules which may be posted, communicated or modified by us or the applicable third parties at any time. Your use of any such plan, offer, product, service, element or feature is subject to those additional terms and conditions, which are hereby incorporated by reference into the Terms,
provided that in the event of any conflict between such additional terms and the Terms, the Terms shall control. This Agreement is to be governed by, and construed in accordance with, the laws of Malaysia.
1.4 Changes to Terms. Policies are subject to change without notice, and should refer to local Studios and staff specifications for the latest update.
Reservation
2.1 Session reservations are accepted via phone call (before 18:00 of the business day before the scheduled lesson), Bakebe online booking system (accessible 24 hours) or in-person at the Studio.
2.2 When making reservations by phone, please call directly to the Studio during business hours (please contact the Studio for details of business hours locally). When making reservations via the phone, it is highly recommended one to double confirm the reservation status on the online booking system. Customers shall be responsible for managing their reservation. The Company [5] and Franchisee shall not be responsible for proactively confirming the status of each individual reservation.
2.3 Cancellation deadline for existing reservation is as follows: Company [6] and Franchisee’s website: Before 12pm of the day before the reserved lesson; In person at Studio/by phone: Before 12pm of the business day before the reserved lesson.
2.4 The Company [7] and Franchisee has the right to freeze the customer’s reservation and attendance in case if the Company [8] and Franchisee considers attendance of the said customer to be inappropriate from legal, financial and/ or other perspectives.
Enrolment and Contract
3.1 Enrolment refers to the acceptance of the terms and conditions outlined herein, and engaging in the Bakebe Studio, membership or sessions. Enrolment is in effect upon completion of the payment.
3.2 Children under 4 years old charges are waived, above 4 years old is chargeable; Below 12 years old must have 1 on 1 parental supervision at all times to attend Bakebe’s class. Guardian form must be signed before starting our baking project.
3.3 Those who have experienced any allergic physical reaction before shall study the menu contents and conformity before enrolment agreement.
3.4 In case of extra classes or sessions such as limited-time menu items, studio-specific menu, partnership events,etc. there may be different conditions for the attendees such as age or gender, as determined by the Company [9] and Franchisee.
3.5 Any campaign discounts, corporate discounts and other types of discounts is to be applied at the time of preparation of enrolment and payment. The Company [10] and Franchisee shall not accept any claims after the customer accepts and signed this user agreement. For details of campaigns and corporate discounts, please check the relevant information at the Studio and Website.
3.6 The Company and Franchisee has the right to withhold the enrolment in case that the Company and Franchisee judges the enrolment is inappropriate.
3.7 All Bakebe sessions are held at: Lot 5, 6 & 7, Level G3, Block C2, Publika Shopping Centre, No. 1, Jalan Dutamas 1, Solaris Dutamas, 50480, Kuala Lumpur.
Sessions
4.1 The Company and Franchisee has the right to alter the products and services, including those provided via the Company and Franchisee’s website, and in the case as such, the Company and Franchisee will notify the alteration by any means out of website, posters, leaflets, and any other medium, and upon notification the alteration is deemed to be accepted by the customer.
4.2 Each customer will be given aprons or may bring one’s own.
4.3 The customer with long hair shall tie up hair due to hygiene reasons. The customer is to remove any accessories around hands and wrists such as ring/watch/bracelet, etc. The customer with long nails or with manicure shall wear gloves while engaging in a Bakebe session.
4.4 For the sake of conducting the sessions per schedule, the customer is to be on time for the reserved lesson at the Studio. Tardiness of more than 15 minutes for any reason is considered as cancelled. In the case as such, the customer will not be able to attend the lesson if the studio is full.
4.5 Copying of the Company and Franchisee’s recipes with illustrations or videos (hereinafter referred to as “Bakebe Recipe”) is prohibited.
4.6 The customer will be leaving the class with their baking creations made at Bakebe. Packaging for the products will be provided by Bakebe but not bags for transfer.
4.7 If the studio is required to close down due to, but not limited to extreme weather conditions, natural disasters,riots, terrorist activities, war or strikes, we retain the right to rebook your Bakebe appointment to the next available date free of charge.
4.8 Customers are required to pay the cost to repair or replace Bakebe’s equipments or tools if damaged or lost. 4.9 Customers who wish to remake their product due to personal negligence (spilled ingredients, took wrong measurements, skipped steps, etc), are required to pay 50% of the marked price as ingredients fee.
4.10 A peer charge of RM60 per person will be included when baking one product with a companion. (max 2 adults OR 1 adult together with 1 children per each project)

4.11 . A peer charge of RM80 for 3 people will be included when baking one product of the specified style
( applicable for 2 adults together with 1 children, 1 adult together with 2 children thats under 12 year old only )
Family Package
Level 1-2 : RM 230

Memberships
5.1 Membership card shall be issued as one per customer.
5.2 Membership card and membership benefits cannot be lent/transferred to others under any circumstances unless indicated explicitly by Bakebe during special campaigns or promotions.
5.3 Membership card and plans will only be activated if guests input requested info via store iPads as prompted. Other channels of signing up shall not count.
5.4 Every member is bound by and must observe the terms and conditions of the Company.
5.5 Members are requested to present personal identity document upon visit to the Company.
5.6 Reservation is required for all baking class.
5.7 If a member cannot attend the reserved classes, he/she should cancel the reservation at least 1 hours in advance. Otherwise, he/she will be liable for all and full charges of the reserved classes.
5.8 Members should check the receipts to ensure that the number of products/classes corresponds with the number of products/classes taken before leaving.
5.9 Products/classes sold or performed are not refundable nor exchangeable. All payments paid by members are not refundable.
5.10 Members can consume class packages within the validity date of their respective products/classes. Any unutilized classes beyond the validity date shall be regarded as expired/invalid and shall not be refundable.
5.11 All products and class packages are non-transferable.
5.12 Should disputes or discrepancies occur, the product type and quantity as printed on the invoice issued shall prevail.
5.13 The Company has the absolute discretion to change, amend, revoke or add to this Terms and Conditions of members from time to time without prior notice.
5.14 Members acknowledge that he/she fully understands the nature and legal consequence of this Terms and Conditions and agrees to be bound by the same.
5.15 The decision of the Company shall be final in case of any disputes between the Company and the members.
5.16 There are English and Chinese versions of this Terms and Conditions. In case of conflict and/or discrepancy, the English version shall prevail.
5.17 The Company has the absolute right to change the types of products/classes to be provided to the members at any time without prior notice.
Corporate Bookings
6.1 Bakebe will hold space and withhold seats from further bookings by other customers during designated session period, only when deposit is fully received with proof of payment provided.
6.2 No refund nor cancellation will be accepted for corporate bookings after 24 hours of payment.
6.3 Sessions will start and end on-time. Teams of corporate bookings are required to arrive at least 15 minutes prior to Session starting. Customers have the right to end the event before the Session’s end-time but will not be allowed to request for refund nor cancellation accordingly.
6.4 In the case of over-time required to exceed scheduled session’s end time, there will be an overtime surcharge applied per minute. Weekday overtime surcharge is RM200 per hour; weekend overtime surcharge is RM400 per hour.
6.5 One recipe can only be shared by up to a maximum of two customers without exception.
6.6 Prior to the start of the Session, full payment for all participants must be paid in full before any member of the corporate booking may begin the Session.
6.7 Each recipe is only available for a maximum of 2 guest and there will be an additional RM60 peer pax if two guest are sharing one same product.
6.8 Children under 12 years old must need full-time guidance by the parent or guardian, otherwise, the company has the right to stop the class.
6.9 Attendees need to submit the “menu item form” three days before the event.
6.10 No changes to the menu can be made after the submission of the Menu Item Form.
6.11 Company booking clients can set up their own venue decorations as appropriate, provided setup and clean up fit into the booking hours also, without damaging material components of the space.
6.12 Bakebe reserves the right to collect for the damages from any broken assets owned by the company. 6.13Bakebe is not responsible for personal belongings of guests on premise.
6.14 Any additional or service fees is not included in the minimum charge calculations, with the exception of peer charges.
Party Table Rental
7.1 Baby chairs may not be allowed within this designated group area, as it can be obstacle for others’ movements.
7.2 Last-minute overtime will be charged by the minute at a weekday rate of RM200/hour, or weekend rate of RM400/hour.
7.3 Guests may setup their own decorations in the Party Table areas designated, but must setup and clean up in entirety to return the space as it was rented in the beginning, all within timing of the booking.
7.4. All Terms and Conditions and other relevant legal waivers must be filled out in full, as requested, only until all documentation as requested is filled out in order to be admitted into the Space.
7.5 Alcohol is not allowed to be brought in from the outside. Food of a particularly strong odor also may not be allowed into premise of the studio.
7.6 Children under the age of 12 will need to be accompanied by an adult, along with disclaimer forms pre-filled out beforehand. One child requires one disclaimer form filled, and cannot be shared across different families.Accompanying adults would need to help children read through iPad instructions step-by-step.
7.7 For Family-friendly classes, each cake can be worked on together, only by up to three people maximum and there will be additional charges RM60 per pax.
7.8 Based on local regulation, Party Table can host up to 12 people at full capacity, or 8 different cakes at a time. For the most updated cadence, please refer to store staff’s recommendation in person.
7.9 The company will hold the venue only when deposit is fully received.
7.10 No refund and cancellation will be possible after 24 hours of payment.
7.11 The booking will start and end on time. Please arrive Bakebe 15 mins earlier.
7.12 The company has the right to end the event when the event cannot be finished within the allotted booking time.

Half-day Rental
8.1 Baby chairs may not be brought into the area of work
8.2 Last-minute overtime will be charged per minute at a weekday rate of RM200/hour and weekend rate of RM400/ hour.
8.3 Personal decorations are not allowed for half-day rentals.
8.4 Appropriate T&Cs must be signed in full before entering the space.
8.5 Full payment of the deposit must be processed and received before space can beheld and booking reserved.
8.6 Customers may not bring alcohol nor strong-odored food into the venue.
8.7 Children under the age of 12 need to be accompanied by an adult, with Parent Consent Authorization form filled out beforehand-in.
8.8 No refund nor cancellation will be accepted for corporate bookings after 24 hours of payment.

8.21 Customers need to submit the Menu Item Form at least 3 days before the event.
8.22 The company reserves the right to collect for the damages from any broken company assets.
8.23 Bakebe may not be able to accommodate reserving the whole venue for last-minute overtime event, the company has the right to restrict a limited space for the event.
Prohibited Activities
The following activities and circumstances are not permitted in Bakebe Studios at any time:
9.1 Customers and companion(s) who have not paid the full fare for their session (including anyone under the age of 18) may not enter the Studio premise. There will be a surcharge of rm60 per pax to the final cost of the session for companions to participate in baking a single product.
9.2 Waiting around or observing inside the Studio is not allowed by general unreserved public, unless if a guardian is waiting on a minor participating inside a Bakebe session.
9.3 Smoking in studio is strictly prohibited as it poses as a fire hazard.
9.4 Activities unrelated to the Company and Franchisee’s business, including unpermitted sales activities, and others are not condoned.
9.5 Attendance for the lesson by anyone other than the reserved guest is not permitted.
Restrictions Regarding Use of Bakebe Recipes, Trademarks and Logos
The following acts are strictly prohibited as it pertains to the Bakebe brand and assets.
10.1 Using Bakebe Recipe’s illustrations and designs, videos, trademarks, logos in unauthorized channels, formats, for commercial and non-commercial purposes.
10.2 Publication of the Bakebe Recipe that is intended for an unspecified number of people, such as the distribution of the Bakebe Recipe through the Internet, without upfront and solicited authorization by Bakebe management, is subject to legal recourse as it is not permissible by law.
10.3 Personal or unauthorized use of Bakebe’s logos, and other Bakebe’s original designs (printed materials,homepage materials, videos), is strictly prohibited when repurposed, reformatted, or applied to both commercial and non-commercial channels.
Handling of Personal Information
In handling customers’ personal information by the Company and Franchisee, any personal information the Company and Franchisee collects will be used solely for the purpose of providing our services. It is our policy to take all necessary steps to ensure that all personal information held by us is processed fairly and lawfully.
Others
12.1 Customers shall take care of all their personal belongings including valuables, as the Company and Franchisee is not responsible for any lost or stolen items, accidents and other troubles that might have caused.
12.2 For any left-behind item, the Company and Franchisee shall keep them for up to 2 weeks. Thereafter, items may be discarded.
12.3 Any activity (solicitation and sales, etc.) that is not related to the Company and Franchisee is strictly prohibited under all circumstances.
12.4 The Company and Franchisee will not beheld responsible for any accident taking place inside the Studio. As for any minor in attendance, all responsibility shall be in their guardians’ custody.
12.5 Any customer with food and atmospheric allergies is responsible of studying the menu list at his or her own course in advance. The Company and Franchisee shall not beheld responsible for any allergic reaction, on- or off- premise deriving from Bakebe experience. We are unable to tailor our recipe content for special dietary requirements, unless otherwise specified by store staff. Please inform Bakebe teams in advance of any allergies,disabilities, diabetes, pregnancy, epilepsy, learning difficulties, and any other ailments as relevant that may affect the guest’s experience.
12.6 In the case of food poisoning, injuries or damages during and after the Bakebe session, Bakebe will not accept any responsibility under any circumstances, as the customer is responsible for the creation and serving of their product during the Bakebe session.
12.7 In case the customer receives a diagnosis of infectious diseases from a certified and licensed medical professional, or has a symptom similar to an infectious disease, the customer may not attend the session regardless of the degree of the disease or symptoms. The customer is to cancel a reservation in advance. In the case if a customer notices any symptoms of infection while at the Studio, the customer is to inform the Studio staff in a most prompt possible manner. The customer may not continue with the session upon judgement by the Studio. *Infectious diseases include measles, chicken pox, mumps, influenza, adenovirus infection, etc.
12.8 The Company and Franchisee has the right to change all or certain parts of this agreement when and where necessary. In that case, the modified agreement shall be effective after one week from the posting date of such matter on the Company and Franchisee’s websites and online channels.
12.9 Rules and regulations regarding other services that the Company and Franchisee offers shall be based on the terms and rules that the Company and Franchisee separately determines, and the beneficiaries of such services are asked to follow those terms.
12.10 Staff personal particulars and contact details are not allowed to be released to the public or any slanders on any social media platform.
12.11 Pets and food and beverages from outside of the premises are not permitted in the Studio for food safety reasons.
Withdrawal Obligation
Any act that violates or is prohibited in this agreement or those that are deemed to be in accordance with the acts outlined below, shall lead to immediate termination of membership.
13.1 Violating the intellectual property rights, copyrights, trademark rights of third parties, or any act that could lead to infringement of such rights.
13.2 Fraud, or any other illegal acts taken.
13.3 Discrimination or slander of other customers, the Company and Franchisee’s employees, and any related parties, or damages made to their credibility or reputation.
13.4 Bothering other customers, the Company and Franchisee’s employees, and related parties (including any acts of harassment), and other criminal acts.
13.5 Advertisement of adult entertainment and related sales activities.
13.6 Any form of speech, solicitation, activities (handing out pamphlets) based on a particular religion, creed or political party.
13.7 Acts that may violate or breach laws and regulations.
13.8 Acts which significantly deviates from the services offered by Bakebe.
13.9 Acts that may cause discomfort or may pose as nuisance to others.
13.10 Consumption of any alcohol.
13.11 Not able to pay in full through the designated payment methods before the start of session.
13.12 Any other acts that the Company and Franchisee may judge as inappropriate under socially acceptable norms.
Refund Policy, Cancellations and Other Charges
14.1 No refund will be made if you fail to attend all or any part of a course, and no rescheduling of a session will be arranged by Bakebe.
14.2 All refunds are made to the source of the initial payment, ie. fees paid by a credit card can only be refunded to the same card.
14.3 Bakebe is entitled to cancel any course at any time subject to the repayment of any deposit and fees received in respect of the course or the part of the course which has been cancelled.
14.4 In the unlikely event of cancellation of a course by Bakebe, we undertake to offer a suitable transfer to an alternative date or course, or a full refund (within 14 days) of any session or class fees. If the course was booked through a 3rd party and not through the Bakebe website or studio staff directly, the customer will need to liaise with said 3rd party to arrange refunds or transfers and Bakebe will not beheld liable for any conflict between 3rd party source and the customer.
14.5 We cannot beheld liable for any third-party costs, such as travel bookings or accommodation with hotels other than our own.
14.6 Cancellations by the guest will not be accepted by Bakebe after a payment has been completed and no refunds will be made.
14.7 Refunds are not available on gift voucher purchases, nor can gift vouchers can be exchanged for cash or other goods in full or partially. Gift vouchers are transferable, so if you are unable to make your course, you may contact us to nominate a replacement. Gift vouchers are valid for one year from their date of purchase. Gift vouchers can be redeemed against any class in the store. Gift vouchers can only be used in the country where the gift voucher was purchased, and cannot be applied to other Bakebe studios or franchises in other regions. All courses are subject to availability and confirmation from Bakebe.
14.8 In the case of damage to Bakebe’s venue, equipment and tools within the studio, the customer responsible for the damage will compensate Bakebe equivalent to the purchase price of said damaged materials.
